Course Description

This webinar will take participants inside some of the most complex and contested issues in commercial liability coverage. Participants will begin by examining how “bodily injury” is defined under ISO CGL and umbrella forms and will examine the ongoing debate over whether emotional injury and mental anguish qualify as bodily injury under current policy language. From there, participants will take an in-depth look at how the duty to defend operates, including reservation of rights, independent counsel considerations, and partially covered claims.

The second half of the session is devoted to coverage triggers under occurrence policies, a critical area for any claim involving long-tail or progressive injury. Participants will also explore allocation theories when multiple policy periods are implicated, including all-sums versus pro-rata approaches, and how horizontal and vertical exhaustion affect additional insured claims.
